【禁闻】法学教授抨重庆"打黑"犹如文革

【新唐人2011年4月15日讯】中国法律学者贺卫方发表公开信，尖锐指出，在四川重庆
的"打黑"行动中，行政权力干预司法等违法现象，让人有时光倒流、文革重演的感受。

北京大学法学院教授贺卫方，在「致重庆法律界的一封公开信」中，直言不讳的指
出，重庆已经持续两年多的"打黑除恶"运动，令人有时光倒流、文革重演之感，法治的
理想正在沦丧。

贺卫方以北京律师李庄案件为例，说明重庆法庭在司法原则中的「基本中立性」已经荡
然无存。

让律师界一年多来牵挂的"李庄案"，重庆市江北区检察院在4月2号提出新的指控，再次
追诉原北京律师李庄。

2009年12月10号，重庆市公安局以李庄在代理重庆龚刚模涉黑案中，以「涉嫌伪证罪」
的理由，对他立案侦查。2010年2月9号，重庆市一中院判处李庄有期徒刑一年零六个
月。

据李庄案代理律师陈有西表示，二审开庭结束后，他去会见李庄时，李庄亲口告诉
他，重庆打黑专案组和检察院要他认罪，只要他认罪，保证不再公开开庭，以书面审
理，并且保证判他缓刑，放他出狱。

结果，重庆专案组在拿到李庄的《认罪书》后，仍决定开大庭审判李庄。对于代理律师
陈有西"揭秘"的内容，重庆官方至今没有给予回应。

贺卫方在公开信中提醒，政府"以黑制黑"，用非法手段打击犯罪，可能造成日后更加可
怕的反社会力量。他还以重庆市「原司法局局长文强的前车之鉴」警告中共，没有独立
的司法，就没有人是安全的，手握大权者也不例外。

就在贺卫方教授和法律界人士呼吁法律公正的同时，中央政法委副秘书长陈冀平却向媒
体表示，"中国是治安最好的国家之一"。

北京律师刘晓原："说社会治安很好，这是高压的管理手段所造成的一种假象。外表看
来似乎很好，潜在的危机没有暴露出来。"

旅美权益人士刘念春表示，中国的治安，将人权搁在一边，是统治阶级意志的体现。

刘念春：你说你是世界上社会治安最好的国家，你还得让人民公认。像钱云会那个事
件，这样的恶性事件都在国内可以发生。那你怎么能说你治安好？而且你这种治安它不
是按照法律程序走的，它是按照统治阶级的意志做的。你采取的是一种暴力手段来维持
你社会治安的局面。"

刘念春认为，对中共当局来说，一切都是为着「维稳」。他举例说，当局抓艺术家艾未
未，事先并没有出示抓艾未未的理由？到底艾未未触犯哪条法律？抓完之后也没有通知
家属，就说明「维稳」是对自由表达的压制。

China One of Best for Law and Order?

During Chongqing's anti-crime movement,He Weifang, a Chinese legal scholar,
wrotean open letter, sharply pointing out, howthe executive branch violated
the judicial branchlike in the Cultural Revolution.

He Weifang, law professor of Peking University,bluntly pointed out that
Chongqing'santi-crime campaign has lasted 2 yearsbut felt like Cultural
Revolution again,indicating the decay of the ideal of rule of law.

He Weifang singled out Beijing lawyer Li Zhuang,illustrating how "basic
neutrality " in the principlesof justice in Chongqing court is completely
gone.

The court in Chongqing brought new allegationsagainst Li on April 2,
causing great concernto the legal profession for more than a year.

Chongqing Public Security Bureau investigated Lion December 10, 2009 for
suspected perjurywhen Li represented Gang Gong in a criminal case.After
that Li was sentenced to 18 months in prison.

According to Li's attorney Chen Youqi, Li told himthat after the second
trial hearing, Chongqing'sSpecial Anti-Crime Group and the
Procuratoratewanted him to plead guilty for no open trialand guarantied
probation instead of a jail sentence.

Li pleaded guilty but the Special Anti-Crime Groupstill decided to an open
trial. Officials remain silentto inquiries of Li's plea bargain.

He Weifang reminded the government that usingIllegal means to fight crimes
may result inworse anti-social forces. He singled out formerJustice
Secretary Wen Qiang to warn authorities:without an independent judicial
branch,no one will be safe, not even those in power.

While He Weifang appealed for justice, deputysecretary general of the
Central Political and LawCommission Chen Yiping told media thatChina is one
of the best countries for law and order.

Beijing lawyer Liu Xiaoyuan: "This good『social order' is an illusion
coming from high-pressure management measures.It looks good and shows no
potential crisis."

America-based rights activist Liu Nianchun thinks that human rights
aside,China's law and order is only a manifestation of the will of the
ruling class.

Liu Nianchun: "You say you are the best countryin social order, but your
people must confirm that.How can you say you are the best in law and
orderand yet allow Chian Yunhui incident to occur?Your law and order comes
from followingthe will of the ruling class.You are using violence to
maintain law and order."

Liu Nianchun believes that the Chinese authoritiesdo everything to maintain
stability. They have not saidwhy Ai Weiwei was arrested; they did not
notifyhis family. All that is called "stability maintenance"but it is
actually suppression of free expression.
