【禁闻】中共控制护照签证 律师:善待人民
【新唐人2011年4月18日讯】近来,全世界华人曝光了越来越多的中共当局拒绝中国公
民出入境的事实,引起国际律师界的关注。在他们眼中,一个政府是否有权利「拒发和
没收公民的护照」?中共当局「控制护照和签证」是为了什么?而中共「取消和限制第
三国签证」又是出自什么心理?请看详细报导。
海外71岁的华人周先生,4月11号下午路过美国纽约的中领馆,看到中国基督徒民主党
成员和一些纽约华人正集会抗议中共的人权迫害,其中有抗议中共利用护照和签证,迫
害华人,他马上现身说法。原来他年轻时到海外后,一直申请不到护照。无国籍、无身
份的状态造成他一生的痛苦。
而美国纽约的基督徒、民主党成员周必萍,在2009年5月去中共驻纽约领馆延期护照时
也被拒绝,并且,他的中国护照被没收。
周必萍:"他说我也不能告诉你理由,你回去吧,护照是不能给你的。"
美国国务院最新公布的《2010年世界人权报告》中也指出,中共当局拒绝很多本国公民
出入境,并阻挠海外的异议人士、人权活动家回国,他们一踏入中国将面临拘禁和关
押。
从业21年的美国职业律师彼得‧高顿认为,中共当局没有任何权利对中国公民拒发护
照。
高顿律师(纽约律师):"无论如何,要让他们有护照,这样一来他们也可以進出欧洲
或其他国家,可以赚钱谋生,抚养家庭。但中国现在的拒发护照,等于是把这些人推入
绝境,特别是他们如果不在美国、没有申请庇护较宽松的环境的话。因此,我不能认同
他们目前的做法。"
高顿律师多年来在帮助大量中国基督徒、法轮功学员的工作中发现,中共是把拒发护照
当作惩罚、惩罚那些公开反对它的人。但是他感到难以理解这种过分的严酷手段。
高顿律师(纽约律师):"对我来讲,非常难以了解中共的这种想法,在美国我们有法
律,有适当的程序,如果你做错了,你要面对你的起诉人,你可以质疑和对质。所
以,我感到非常难以理解,一个政权居然可以通过控制护照来控制国民的出行和回国。
"
目前生活在日本的法轮功学员章俊是家里的独生子,8年来他无法和父母亲团聚,因为
他的父母也是法轮功学员。2010年,当他的父母第七次到江西省鹰潭市外事处申请护照
时,依旧被要求先写"不炼法轮功"的保证书,才能得到护照。
章俊在海外媒体《大纪元》上曝光了一份他父母的护照申请表,在"单位或派出所意见
"栏里写着:"属于法规定的不准出境五种情形,『法轮功'练习者,报上级审批。"
《血腥的器官摘取》作者大卫麦塔斯,曾调查过法轮功学员在中国的真实处境。据他披
露,那些批评中共政府人权的学者,尤其是批评中共对待法轮功态度的学者,是不会获
得進入中国的签证。
他认为,中共这样做是为了"控制政权,他们要确定让谁進中国,或让谁出中国,都是
用中共自己的利益来衡量后决定的。"
在中共控制华人的办法中,还有一类是限制或取消「第三国签证」的方式。「第三国签
证」是指外籍人士可以到其他国家的本国领事馆去申请非移民签证,不必回原居地签
证。中共和大量西方国家签订了「取消和限制第三国签证」的协议,这样海外中国人在
签证所在国,如果想去第三国就必须回中国大陆申请签证。
高顿律师(纽约律师):"中共以注销或拒绝护照延期为惩罚手段,那些国民就被困在
第三国,成为该国的问题,这些国家应该像美国一样,或者给予这些人庇护,或者站出
来向中共政权施加压力,要中共还是得发护照给这些人,让他们可以到其他国家。"
据海外独立媒体《大纪元》特稿分析指出,在这一环节中,控制中国人是"中共在制造
"到哪儿都逃不出我的手心"的恐怖,同时,也把它对「垮台」、「党文化破产」充满恐
惧的黴暗心理,昭告天下"。
高顿律师:"请跟上时代。人民是国家的巨大财富,要善待他们,如果不这样的话,你
就将失去你在政府的位置,而且会很快。"
高顿律师呼吁并警告中共的同时,也相信中国人一定会获得自由和民主。

China Control Passports and Visas on Dissidents
Recently, more and more Chinese stood up to revealthe fact that the Chinese
regime refused its citizensto leave or enter China. This draws the
internationalattention. Does a government have the right to refuseissuing
or confiscate passports? What are the purposeof Chinese authorities'
controlling passport and visa?What is the CCP's third-country visa
cancellation andrestrictions for? Let's take a look at whatan international
lawyer has to say.
Mr. Zhou, an overseas Chinese, 71, passed by ChineseConsulate in New York
on April 11, seeing members ofthe China Christian Democratic Party and some
otherChinese in New York gathering to protestthe Chinese Communist
persecution of human rights,including protest against CCP's using passports
andvisas to persecute Chinese nationals. He immediatelyshared his
experiences. After he came to the U.S. ata young age, he could not get a
Chinese passport.It is his life-long pain to have no national identity.
Christian Democrat Zhou Biping in New York had hispassport renewal denied
in May 2009 by Chineseconsulate in New York, and his Chinese passport
wasconfiscated.
Zhou: "He said, 『I can't tell you the reasons either, please goback, and
the passport could not be given to you.'"
U.S. State Department recently released the2010 World Human Rights Report,
noting Chineseauthorities refused entry or exit of their citizens,
andblocked overseas dissidents, human rights activists toreturn to homeland
China. Those will face detentionand imprisonment once they enter China.
U.S. professional attorney Peter Gordon with 21 yearsexperience, believes
that the Chinese authorities haveno right to refuse to issue passports to
Chinese citizens.
"In any case, let them have a passport, so that theycan go to Europe or
other countries, can make moneyto make a living and raise their families.
But nowChina's refusal to issue passports, pushing them intoa desperate
condition, especially if they are not in US,and do not have a more relaxed
environment to applyfor asylum. So I can't concur with their current
practice."
Gordon has been helping a large number of ChineseChristians and Falun Gong
practitioners over years.He found the CCP refused to issue passports as
apenalty to punish those who openly oppose it.He found it difficult to
understand such aharsh, cruel way.
"It is very difficult for me to understand the idea ofthe CCP. In the U.S.,
we have laws and proper procedures.If you screwed up, you have to face the
prosecution ofyour people, but you can challenge and confront.So I am very
confusing that a regime can actuallycontrol citizens' entry and exit of
China by controllingtheir passport."
Falun Gong practitioner Zhang Jun, currently living inJapan, is the only
son of his parents. He could not joinhis parents for over 8 years, because
his parents arealso Falun Gong practitioners. In 2010, when hisparents went
to Foreign Affairs Office in Yingtan,Jiangxi Province to apply for
passports, they wereasked to write a statement to denounce Falun Gongbefore
a passport can be issued.
Zhang Jun exposed on the Epoch Times the passportapplication form of his
parents. In the "Departmentor Police Station Comments" column it
read: "Theyare within five kinds of situations which are notallowed to
leave China, Falun Gong practitioners, soreport to higher authorities for
approval."
Author of Bloody Organ Harvesting David Matashas investigated the real
situation of Falun Gongpractitioners in China. According to his
disclosure,scholars who criticize Chinese government on humanrights,
especially on the treatment of Falun Gong,will not get a visa to enter
China.
He believes that the CCP does this to "control the power.They determine who
should be allowed into China,or who should be allowed out of China. These
are allmeasured by the interests of the CCP.'
Among the Communist control of Chinese is anothercategory that limits or
abolishes the "3rd country visa.""Third country visa" means foreigners can
go to theirconsulates in other countries to apply theirnon-immigrant visa,
and do not need to go to originalresident place for a visa. The CCP signed
contracts witha large number of Western countries on "3rd countryvisa
cancellation and restrictions", so that forChinese in the country of
current visa, if they want togo to a third country , they must return to
mainlandChina to apply for a visa.
The CCP canceled or refused citizens' passport extensionas punishment,
making them trapped in a thirdcountry and becoming the country's problem.
Thesecountries should learn from the U.S. to give them asylum,or stand up
to pressure the Chinese regime to issuea passport to them so that they can
go to other countries.
According to independent media Epoch Times,during this session, what
controls Chinese isthe terror of "You could not escape my palmwherever you
are" created by the CCP. Meanwhile,these articles revealed the CCP's fear
of collapse andparty culture bankruptcy.
Upon learning that the Governor was coming to visit,Please keep up with the
times. People are greatnational wealth. Treat them nicely, otherwise you
willlose your position in the power very soon.
While Gordon warned the CCP for what it has done,he believes Chinese people
are bound to obtainfreedom and democracy.
