【禁闻】我的护照为什么中共做主？

【新唐人2011年4月9日讯】大陆当局利用护照和签证，控制并迫害民众的事情，近来引
起全世界的关注。中共官方都采用什么手段去做的？他们这样做合乎国际公约和大陆相
关的法律吗？中国人应该如何破除这种限制？请看详细报导。

大陆当局限制民众出国，近来引起国际关注。先是3月底，中国作家廖亦武被禁止出
国，然后是4月3号，大陆知名艺术家艾未未被首都机场的警员拦下，之后，艾未未音信
全无，多国政要要求中共当局放人。

据了解，中共限制国民出入境的一系列措施，是在上世纪80年代以后逐渐成型的。其中
也包括禁止某些持有合法护照的海外中国人回国，这些中国人在申请中国护照延期，或
更换护照时，海外的中使馆、领馆就扣留他们的护照。

从99年中共镇压法轮功以来，海外就有上百名法轮功学员被当地使、领馆剥夺了海外的
合法身份证明――护照，给他们在找工作、租房子等正常生活，带来很大的不便。而上海
的维权人士冯正虎，在日本成田机场坚持了90多天的回国权，更是轰动了全世界。

加拿大女作家盛雪，在1996年持加拿大护照和中国的合法签证，想回国和母亲共度中秋
节，却被大陆国安拦截在机场里，经历了24小时的轮番审讯，最后被驱逐出境。

加拿大作家盛雪："实际上，利用人的亲情、友情、乡土情、思念亲人的这种人类最基
本的这样一种伦理情感，来胁迫人，然后迫使人去放弃自己的信念，迫使人向一种权利
不得不做出让步，这可以说是最最最邪恶的一种做法。"

除了禁止国人正常出入境外，中共也在签证上控制西方人入境。《自由亚洲》、《美国
之音》的多位华人和西方记者，经常无法得到中共的签证，因而无法报导中国正在发生
的新闻事件，尤其是第一现场的报导。

德国著名的汉学家马汉茂教授，在1989年到1999年期间，也被大陆当局严格的排斥在入
境外，因为他看到89年六四屠杀后公开站出来，坚决反对中共集权，10年中，他在自己
的良知和事业无望的痛苦中煎熬。最后在1999年，当他主持完「六四」10周年的公祭
后，马汉茂翻身跳下楼去，用生命来抗议这种不公。

按照普世的认识，一个人出生后，他的国籍和出生时间、性别一样，是与生俱来的。在
国际法公约中，《世界人权宣言》明确"人人有权享有国籍"，"任何人的国籍不得任意
剥夺。"即便在中共自己的《护照法》里，也堂而皇之的在第二条写道："任何组织或者
个人不得伪造、变造、转让、故意损毁或者非法扣押护照。"而"非法护照由公安机关收
缴"，因此，按照大陆自己的法律，海外的使、领馆只有为海外华人服务的权利，也就
是�，只办理延期和更换护照。

中国政法大学的著名宪法学者陈小平，曾在美国中领馆申请延期护照时被拒绝，随后他
向人大和人大常委会提起宪法起诉。

时事评论员横河："他（陈小平）就提出来：在中国的国籍法里面国籍是不可被剥夺
的，而护照是国籍的证明。他提到，虽然中国的出入境管理条例里面有吊销和护照作废
的规定，但是那必须是原发证机关或者上级机关做出来，而总领馆是没有这个资格的。
"

一位目前隐身在北美的中共原公安部高官表示，中共千方百计的控制人员出去，是怕自
己的丑行曝光；另一方面，又控制境外的所谓的敌对势力�去。

中共前驻悉尼总领事馆外交官陈用林："它（中共）主要就是为它的政权考虑，是不是
对它的政权有利，就是它认为有可能会影响到它政治稳定，它宁可冤枉一万，也不要放
过一个。就是…这个政权它首先考虑的就是利益集团、政权本身的稳定，和个人的私
利。"

《大纪元时报》编辑部也发出特稿指出，拥有个人护照是一个公民最基本的权利，而中
共却利用它来向世界炫耀说："到哪儿都逃不出我的手心"，中共的这种作法是流氓控制
的暴力手段。

加拿大作家盛雪："在这个过程当中，最大的悲剧就是许多人在内心逐渐形成一种恐
惧，喔！我这样说的时候会不会惹得这个共产党对我�行报复，那么很多人形成这么一
个思维惯性，（中国）人确实成为一个不能独立思想、没有基本道德规范的一群生物。
"

旅德极权主义问题专家仲维光在1997年，也被中共海外领馆剥夺护照，使他在母亲重病
卧床的3年期间，无法回国尽孝，更没能让母亲临终前看到他最后一眼。作为研究极权
主义问题的学者，他非常清楚制造恐怖和谎言，是极权社会的两个最重要的特点，所
以，他认定，要想摆脱专制就得勇敢而智慧的去冲破限制。

旅德极权主义问题专家仲维光："不去配合它（中共），采取必要的策略、必要的措
施，不买它的帐！你去接受一个传单、去传播一个真相、去听一场非党文化的音乐，去
唱一首非党文化的歌，都是对抗它的方法。"

北美一位资深的人权活动家向《新唐人》表示，联合国没有针对一国政权剥夺公民护
照、造成国籍难民这方面问题的特派专员，因为中共的做法在全世界是独一的。他表
示，世界上其他国家和联合国可能想都没想到，还能有这样无耻的迫害民众的行为。

Why Does Chinese Regime Control My Passport?

Mainland authorities use passports and visas to controland persecute
people, causing worldwide concern.What means do Chinese officials take? Do
they actaccording to relevant international conventionsand mainland law?

Mainland authorities restrict people to go abroadCausing international
attention. First, Chinese writerLiao Yiwu was prohibited to go abroad, at
the end ofMarch, later well-known artist Ai Weiwei was stoppedat the
airport on April 4. No one knows his whereaboutssince. Leaders from many
countries requestedfor his release.

It is understood, after 1980, Chinese authorities slowlyshaped up measures
to restrict people for immigration,including prohibition of certain
passport holdersto return. Overseas embassies or consulates withheldtheir
passports when they applied for passportextension or passport replacement.

Since the persecution of Falun Gong in 1999, Chineseembassies or consulates
withheld hundreds of legalidentification of Falun Gong practitioners and
causedtremendous inconvenience in finding a job or rentingan apartment.
Rights activist Feng Zhenghu stayed ina Japan airport for over 9o days for
his right to returnto China and shocked the entire world.

In 1996, Canadian writer Sheng Xue had a legitimateCanadian passport and
Chinese visa, hoping to go backand spend Mid-Autumn Festival with her
mother.She was intercepted at the airport by State Police.After a 24-hour
interrogation, she was deported.

Sheng Xue (Canadian writer):"In actuality, to exploit human affection,
friendship,love of hometown and love ones to intimidate peopleand force
people to give up their conviction or makea concession to a certain power.
It's the most evil of all.

In addition to the normal immigration ban, authoritiesalso control the
entry visa of Westerners.Many Chinese and western reporters from "Free
Asia"and "Voice of America" often fail to get a visa andtherefore cannot
report events taking place in China,especially the first report of an event.

A famous German Sinologist professor Ma Hanmao,was strictly excluded from
entry during 1989-1999.Because he openly and firmly opposed
communisttotalitarianism after watching the 1989 massacre.He suffered pain
from his own conscience and failedcareer for 10 years. In 1999, after
finishing "June 4"ceremony for the 10th anniversary, he jumped offa
building and protested against that kind of injustice.

Based on the universal understanding, nationality andtime of birth, sex,
come with the birth of a person."The Universal Declaration of Human Rights"
ofthe international law, declares "Everyone has the rightto a nationality".
Even in China's "Passport Act",in the second act: "Any organization or
individual maynot counterfeit, alter, transfer, intentionally damagedor
illegally seized passport, but public security bureaucan confiscate illegal
passports. According to the lawin mainland, embassies and consulates
overseas haveonly an obligation to provide services, namely,
processapplications for passport extension or replacement.

Chen Xiaoping, a leading constitution scholar fromChina University brought
charges against the ChineseConsulate in the U.S. and then the NPC and
theStanding Committee after his application for passportextension was
denied.

Yokogawa (political commentator):"He pointed out that nationality cannot be
deprived innationality law in China, and passport is a proof ofnationality.
He said that although there are invalidpassports revoked, the provision of
it must bethe original issuing authority or a higher authorityto do it, the
Consulate General is not qualified.

Hiding in U.S. a former official of public security said,the mainland
authorities are trying to prevent peoplefrom going abroad for fearing of
exposure of their baddeeds; meanwhile disallow the oppose force to come in.

ChenYonglin (ex diplomat at the PRC ConsulateGeneral in Sydney):

"The Chinese Communist Party(CCP) thinks mainlyfor its own political power.
Is this good for the Party?if it may affect its political stability, it
would ratherkill ten thousand wrongly but not miss one.The regime's first
consideration is interest groups,the stability of the regime itself, and
personal interest. "

A special editorial from The Epoch Times also pointedout: A personal
passport is the most basic rights ofa citizen, and the Chinese authorities
use it to boastto the world that one cannot escape from its clutches.This
kind of practice by the Chinese Communist Partyis a gangster �controlled
violence.

Sheng Xue (Canadian writer):

"During this process, the greatest tragedy is that manypeople gradually
become fearful in their hearts.Oh! when I say that,the CCP will retaliate
against me.Therefore, many people formed such a belief thatChinese cannot
think independently, they are nothingbut a bunch of organisms with no basic
moral standards.

In 1997, the Chinese overseas consulate withheldZhong Weiguang's passport.
Zhong is an expert intotalitarian but lived in Germany. His mother
wasseriously ill. And he was prevented from seeing hismother before her
death. Being a totalitarianismscholar, he knows well creating terror and
lyingare two main traits of totalitarian society. He thinkscourage and
wisdom are needed to be free of tyranny.

Zhong Weiguang (totalitarian expert touring in Germany):"Don't cooperate
with CCP, use necessary strategiesand necessary measures, do not play
along. Taking aflyer, clarifying one truth, or listening a non-Partyculture
concert and singing a non-Party song are allmethods against the Party.

A veteran human rights activist in North Americatold "New Tang Dynasty"
that the United Nationsdo not have special agents to deal with
citizensbeing deprived of passports and turning into refugesof the world.
Because the action taken by the CCPis the one and only in the entire world.
Such ashameless persecution of its own citizens is farbeyond any country's
imagination.
